CONDITIONS OF SALE

1) This Shetland Sheepdog puppy (described above) is being sold as a performance prospect. This puppy is to be considered a companion and as such a house dog which shall not be left out in the weather. BUYER agrees to provide this Shetland Sheepdog puppy with a fenced yard and will not permit this puppy to run loose outside its owner's yard, or it's owners verbal control.

2) In addition to the hereditary defect guarantee described below, this Shetland Sheepdog puppy is guaranteed to be in good health, upon arrival, and for a period of ten days from the date of actual delivery to the BUYER. If any serious medical problem is found, upon written certification from the Buyer's veterinarian and confirmed by the Seller's veterinarian, this Shetland Sheepdog puppy may be returned for a refund of the purchase price.

3) The BUYER will be provided with a complete record of all inoculations and wormings at the time of sale.

4) BUYER agrees to use the Seller's kennel name of “Plail's” as the prefix for said dog’s AKC name.

5) This Shetland Sheepdog puppy (described above) is being sold as a performance prospect . It is understood and guaranteed that with proper care and socializing on the part of the Buyers, the dog will be of acceptable temperament and structure when mature.

6) This dog is guaranteed to be free from hereditary crippling defects for 3 years. Should the above dog develop a hereditary crippling defect, such that a performance career is not an option, the dog will be replaced with another dog of equal value when one is available (with proof of veterinarian examination along with written referral by veterinarian to retire said animal due to nature of hereditary condition.) All medical records, tests and office notes conducted on this puppy shall be provided to seller as soon as the possibility of any defect presents itself. In the event of an allegation of a defect, the OFA registry shall be used as an unbiased registry to provide a diagnosis or score for hips, elbows and thyroid. Eye issues will be analyzed using the CERF test. No other diagnosis, opinion or conclusion shall be valid under this contract, aside from the registries listed above. All thyroid results shall be processed through Michigan State Lap.

7) If the Buyer should ever decide that they can no longer keep this Shetland Sheepdog for any reason the Buyers shall notify the Seller. The Seller will have the first option to buy said dog back from the buyers for an amount equal to what the Buyers paid.

8) All parties acknowledge and agree that, as part of the consideration for this transaction, no party shall sell or otherwise transfer any puppy resulting from this dog to any pet store, wholesale or retail pet dealer, flea market, guard dog business, research facility or any private individual or breeder. In addition, this puppy shall not be transferred to any other party, nor shall it be sold as a competition dog.

9) The BUYER is not acting as an agent for any other party in the purchase of this Shetland Sheepdog.

10.) AKC registration/ownership to this puppy shall be given to buyer. This puppy is to be spayed/neutered by his/her 12 month birthday. Breeding of this puppy is expressly prohibited unless prior arrangements and written permission are granted by seller. Additional consideration and fees are due if registration is converted to a full registration for breeding purposes. Such consideration shall be negotiated prior to converting registration.

11. This puppy will be provided with ample exercise and freedom of movement. "Closed Economy" training methods shall not be utilized and this puppy shall not be excessively crated nor deprived of reinforcements and other pleasures to any excessive extent.

12. Any conflicts arising under this contract and this contract itself, is to be litigation in the state of Florida, in Pasco County.

ENTIRE AGREEMENT

It is understood and agreed that the BUYER, by signing this form, has read and understands the conditions of this contract. Furthermore this written agreement constitutes all the conditions of the sale and no verbal statements made, either before or after the sale, will be binding in any way. This agreement shall not be in effect until both the signatures are affixed below and payment has been made. ACCEPTED AND AGREED:
